TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of genetikaskin.com (the “Site”), including any purchases, subscriptions, content, features, and services offered through the Site.

The Site and the GenetikaSkin brand are owned and operated by Arcadia Labs, LLC, a Wyoming limited liability company (“GenetikaSkin,” “Company,” “we,” “us,” or “our”).

By visiting the Site, creating an account, placing an order, enrolling in a subscription, or otherwise using our services, you agree to be bound by these Terms and by any additional policies referenced herein, including our Privacy Policy and Return & Refund Policy.

If you do not agree to these Terms, you must not access or use the Site.

1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to make a purchase or enroll in a subscription through the Site.

By using the Site, you represent that:

  • You have the legal capacity to enter into a binding agreement;

  • The information you provide is accurate and complete;

  • You are purchasing products for lawful, personal use; and

  • You will comply with these Terms and all applicable laws.

The Site is not intended for children under 13 years of age.

2. Changes to These Terms

We may update these Terms periodically to reflect changes to our services, business practices, or applicable laws.

The updated Terms will be posted on this page with a revised “Last Updated” date. Changes will apply prospectively unless applicable law requires otherwise.

Material changes affecting an active subscription will be communicated as required by law. Your continued use of the Site after an updated version becomes effective constitutes acceptance of the updated Terms, except where additional consent is legally required.

3. Products and Cosmetic Information

GenetikaSkin offers cosmetic skincare products intended for external use.

Product descriptions, images, ingredient information, directions, and other content are provided for general informational purposes. We make reasonable efforts to display product information accurately, but packaging, colors, dimensions, ingredients, and appearance may differ slightly from what is shown on your screen or may change as products are updated.

Results from cosmetic products vary between individuals based on factors including skin characteristics, age, routine, frequency of use, environment, and other personal circumstances. We do not guarantee that every customer will experience the same results.

Any satisfaction guarantee is governed exclusively by the conditions stated in our Return & Refund Policy.

4. No Medical Advice

The Site and GenetikaSkin products do not provide medical advice and are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Content available through the Site, advertisements, emails, social media, customer reviews, and customer support communications is provided for general cosmetic and informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

Consult a qualified healthcare professional before using a product if you:

  • Have a diagnosed skin condition;

  • Are pregnant or breastfeeding;

  • Have known allergies or sensitivities;

  • Are using prescription skincare or medication;

  • Have recently undergone a cosmetic or medical procedure; or

  • Have concerns regarding whether a product is appropriate for you.

Discontinue use if irritation or an adverse reaction occurs. Seek medical assistance when appropriate.

5. Product Use and Safety

You agree to review the product label, ingredients, warnings, and directions before use and to use each product only as directed.

Unless the product instructions expressly state otherwise:

  • Products are intended for external use only;

  • Avoid direct contact with the eyes;

  • Keep products out of reach of children;

  • Do not use a product if its seal appears damaged or tampered with;

  • Do not use products on broken or severely irritated skin; and

  • Perform a patch test before initial use if you have sensitive or reactive skin.

You are responsible for determining whether a product is suitable for your personal circumstances.

6. Accounts

Certain Site features may allow or require you to create an account.

You agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your password and account credentials and for all activity occurring through your account.

Notify us promptly at info@genetikaskin.com if you believe your account has been accessed or used without authorization.

We may suspend or terminate an account where we reasonably believe it is being used fraudulently, unlawfully, to abuse our policies, or in violation of these Terms.

7. Orders

Submitting an order constitutes an offer to purchase the selected products. An order is not accepted until we send an order confirmation or begin processing the order.

We reserve the right, where permitted by law, to reject or cancel an order for reasons including:

  • Product unavailability;

  • Pricing or product-information errors;

  • Suspected fraud or unauthorized payment activity;

  • Suspected resale or commercial purchasing;

  • Violation or abuse of a promotion;

  • Violation of these Terms; or

  • Shipping restrictions.

If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method.

An automated order confirmation does not constitute a guarantee that every ordered product will be available.

8. Prices, Taxes, and Payment

Prices are displayed in the currency indicated on the Site and may change without notice. A price change will not affect an order already accepted, except in the event of an obvious pricing error.

Applicable sales taxes, shipping costs, and other permitted charges will be disclosed during checkout.

By submitting payment information, you represent that:

  • You are authorized to use the selected payment method;

  • The payment information is accurate;

  • You authorize us and our payment processors to charge the total displayed at checkout; and

  • For subscriptions, you authorize recurring charges in accordance with the terms disclosed before enrollment.

Payments may be processed by third-party payment providers. We do not directly control their services, security procedures, or processing times.

We may correct pricing or typographical errors and cancel an affected order. If you have already been charged, we will issue an appropriate refund.

9. Subscriptions and Automatic Renewal

GenetikaSkin may offer products through recurring subscription plans.

Before you enroll, we will clearly disclose the material subscription terms, including:

  • The products included;

  • The amount you will be charged;

  • The frequency of delivery and billing;

  • Whether any introductory or promotional pricing applies;

  • When promotional pricing ends;

  • That the subscription automatically renews until canceled; and

  • How to cancel.

By affirmatively selecting a subscription option and completing checkout, you expressly authorize Arcadia Labs, LLC and its payment processors to charge your selected payment method automatically at the frequency and price disclosed at enrollment, together with applicable taxes and shipping charges, until you cancel.

Automatic Renewal

Your subscription will automatically renew for successive billing periods until canceled.

You are responsible for ensuring that your payment, billing, and shipping information remains current. If a payment cannot be processed, we may retry the payment, request an updated payment method, pause the subscription, or cancel it.

Subscription Confirmation and Notices

After enrollment, we will provide a confirmation containing the material subscription terms and cancellation instructions.

We will provide renewal reminders, price-change notices, trial-ending notices, and other subscription communications where and when required by applicable law.

How to Cancel

You may cancel your subscription through the online account or subscription-management method made available on the Site. You may also request cancellation by emailing info@genetikaskin.com.

Cancellation will not require you to use a method that is materially more difficult than the method used to enroll.

To prevent the next recurring order, you must cancel before that order begins processing. A cancellation submitted after an order has entered processing may take effect beginning with the following billing cycle.

After cancellation, you will not be charged for future subscription periods. Canceling a subscription does not automatically cancel or refund an order that has already been processed, shipped, or delivered.

Returns and refunds for processed subscription orders are governed by our Return & Refund Policy and applicable law.

Subscription Changes

Available subscription frequencies, products, discounts, and benefits may change. Where required, we will provide advance notice before a material change or price increase takes effect.

If additional consent is required by applicable law, we will obtain that consent before applying the change.

Subscription discounts apply only while the subscription remains active and may not be combined with other offers unless expressly stated.

Free Trials and Promotional Periods

If we offer a free trial or reduced-price promotional period, the duration, renewal price, billing date, and cancellation deadline will be disclosed before enrollment.

Unless canceled before the disclosed deadline, the subscription will convert to a paid recurring subscription at the price and frequency presented when you enrolled.

10. Promotions and Discount Codes

Promotions, bundles, gifts, discount codes, and special offers may be subject to additional terms.

Unless otherwise stated:

  • Promotions cannot be combined;

  • Discount codes have no cash value;

  • Promotions cannot be applied retroactively;

  • Offers may be limited by customer, household, order, product, or time period;

  • Free gifts are available only while supplies last; and

  • Promotions may be modified or withdrawn before an order is placed.

We may cancel or adjust orders involving suspected promotional abuse, duplicate accounts, automated purchasing, or other attempts to circumvent offer restrictions.

11. Shipping and Delivery

Shipping estimates are estimates and are not guaranteed unless expressly stated otherwise.

You are responsible for providing a complete and accurate delivery address. GenetikaSkin is not responsible for delays or losses caused by an incorrect or incomplete address provided by the customer, refusal of delivery, failure to collect a package, customs processing, weather, carrier disruption, or other circumstances outside our reasonable control.

If we cannot ship an order within the time stated on the Site, or within the period required by applicable law when no time is stated, we will provide any notice, cancellation option, or refund required by law.

Title and risk of loss pass as provided by applicable law and the shipping terms presented at checkout.

Additional conditions relating to missing, refused, damaged, or undeliverable packages are contained in our Return & Refund Policy.

12. Returns, Refunds, and Satisfaction Guarantee

Returns, refunds, replacements, damaged-product claims, and the GenetikaSkin 99-Day Satisfaction Guarantee are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.

The Satisfaction Guarantee is a limited commercial guarantee and is subject to its stated eligibility requirements, exclusions, deadlines, and anti-abuse conditions.

Nothing in these Terms limits consumer rights that cannot legally be waived.

13. Personal and Noncommercial Use

Products sold through the Site are intended for personal use and not for unauthorized resale, redistribution, export, or other commercial activity.

You may not purchase products for resale without our prior written authorization. We may limit quantities, reject orders, cancel orders, or suspend accounts where purchasing activity reasonably appears to involve unauthorized resale, diversion, or fraud.

14. Acceptable Use

You may not use the Site:

  • For an unlawful, fraudulent, or abusive purpose;

  • To violate another person’s rights;

  • To interfere with the Site’s operation or security;

  • To introduce malware, malicious code, or harmful technology;

  • To scrape, crawl, harvest, or extract Site data through automated means without authorization;

  • To attempt unauthorized access to an account, server, database, or network;

  • To impersonate another person or misrepresent your identity;

  • To submit false reviews, claims, or refund requests;

  • To interfere with another customer’s use of the Site; or

  • To reproduce or exploit the Site or its content for unauthorized commercial purposes.

We may restrict or terminate access where we reasonably believe these restrictions have been violated.

15. Intellectual Property

The Site and its contents—including the GenetikaSkin name, logos, product names, packaging, photographs, graphics, videos, text, designs, software, product descriptions, advertisements, and other materials—are owned by or licensed to Arcadia Labs, LLC and are protected by applicable intellectual-property laws.

You are granted a limited, revocable, nonexclusive, nontransferable license to access and use the Site for personal, noncommercial purposes.

No content may be copied, reproduced, republished, distributed, modified, sold, licensed, displayed, or commercially exploited without our prior written permission.

Nothing in these Terms transfers ownership of any intellectual property to you.

16. Reviews and User Content

You may have the opportunity to submit reviews, photographs, videos, comments, testimonials, or other content (“User Content”).

You retain ownership of your original User Content. By submitting it to us or tagging GenetikaSkin in content that you invite us to use, you grant Arcadia Labs, LLC a nonexclusive, worldwide, royalty-free, sublicensable, transferable license to host, reproduce, adapt, publish, display, distribute, and use that User Content in connection with operating, promoting, and improving GenetikaSkin.

Where required, we will obtain separate permission before using a person’s image or testimonial in paid advertising.

You represent that:

  • You own or have permission to submit the User Content;

  • The content reflects your honest experience and opinions;

  • The content is not false, misleading, defamatory, unlawful, or infringing;

  • You have disclosed any material relationship, payment, gift, discount, or incentive connected to the content; and

  • The content does not contain another person’s private or confidential information.

We may moderate or remove User Content, but we are not required to publish or retain every submission.

17. Feedback

If you send ideas, suggestions, or feedback regarding GenetikaSkin, you permit us to use that feedback without restriction or compensation, provided that doing so does not override any rights granted to you under applicable privacy law.

18. Third-Party Services and Links

The Site may contain links to or integrations with third-party websites, payment processors, shipping carriers, social networks, and service providers.

We are not responsible for third-party content, availability, security, products, services, or privacy practices. Your use of third-party services may be governed by separate terms and policies.

A link or integration does not necessarily constitute our endorsement of the third party.

19. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By using the Site, you acknowledge that you have reviewed the Privacy Policy. Consent to receive marketing emails or text messages, where offered, is separate from accepting these Terms and is not a condition of purchase.

20. Electronic Communications

You consent to receive transactional communications electronically, including order confirmations, subscription notices, shipping updates, policy notices, and customer-service communications.

You may withdraw from marketing communications using the unsubscribe method provided in the communication. Unsubscribing from marketing does not prevent us from sending non-promotional communications relating to an order, subscription, account, safety issue, or legal obligation.

21. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, ITS CONTENT, AND THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

ARCAdia Labs, LLC DISCLAIMS ALL WARRANTIES NOT EXPRESSLY PROVIDED IN WRITING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL ALWAYS BE AVAILABLE, SECURE, ACCURATE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

THIS DISCLAIMER DOES NOT EXCLUDE WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LEGALLY BE DISCLAIMED.

22. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCADIA LABS, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO THE SITE, PRODUCTS, OR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID TO GENETIKASKIN FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM; OR

  2. ONE HUNDRED U.S. DOLLARS (US $100).

These limitations do not apply to liability that cannot lawfully be limited or excluded, including where applicable liability for fraud, willful misconduct, gross negligence, or personal injury caused by a legally defective product.

Some jurisdictions do not allow certain limitations. In those jurisdictions, the limitations apply only to the maximum extent permitted by law.

23. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Arcadia Labs, LLC and its affiliates, members, managers, employees, and service providers from third-party claims, liabilities, damages, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the Site;

  • Your violation of these Terms;

  • Your infringement of another person’s rights; or

  • User Content submitted by you.

This provision does not require a consumer to indemnify us for our own unlawful conduct, negligence, product liability, or breach of these Terms.

24. Informal Dispute Resolution

Before filing arbitration or a lawsuit, you and Arcadia Labs, LLC agree to attempt to resolve the dispute informally.

You must send a written notice to info@genetikaskin.com containing:

  • Your name and contact information;

  • Your order number, when applicable;

  • A description of the dispute;

  • The relief requested; and

  • Relevant supporting information.

We will send any dispute notice to the most recent email or mailing address associated with your account or order.

The parties will have 30 days after receipt of the notice to attempt an informal resolution. Either party may proceed after that period if the dispute has not been resolved.

This requirement does not prevent either party from seeking urgent injunctive relief where legally appropriate or from bringing an eligible claim in small claims court.

25. Binding Individual Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for eligible small claims matters and claims seeking urgent injunctive relief concerning intellectual-property misuse or unauthorized access, disputes arising from or relating to these Terms, the Site, an order, a subscription, a product, or your relationship with GenetikaSkin will be resolved through binding individual arbitration rather than in court.

The arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules. If AAA is unavailable or unwilling to administer the dispute, the parties will select another recognized arbitration provider or ask a court of competent jurisdiction to appoint one.

The arbitration may take place by telephone, video conference, document submission, or at a reasonably convenient location, as permitted under the applicable rules.

Arcadia Labs, LLC will pay arbitration fees to the extent required by the AAA Consumer Arbitration Rules or applicable law.

The arbitrator may award the same individual remedies that would be available in court, subject to these Terms and applicable law.

Nothing in this section prevents you from reporting a matter to a federal, state, or local government agency. An agency may pursue relief where legally authorized.

26. Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND ARCADIA LABS, LLC AGREE THAT EACH PARTY MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY.

NEITHER PARTY MAY BRING OR PARTICIPATE IN A CLASS, COLLECTIVE, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION IN ARBITRATION.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.

If a court determines that a particular request for public injunctive relief cannot lawfully be waived or arbitrated on an individual basis, that request will be decided by the court after all arbitrable claims are completed.

27. Right to Opt Out of Arbitration

You may opt out of Sections 25 and 26 by emailing info@genetikaskin.com within 30 days after the date you first accept these Terms.

Your opt-out notice must include:

  • Your full name;

  • The email address associated with your account or order;

  • A clear statement that you wish to opt out of arbitration; and

  • The date of the request.

Opting out will not affect any other provision of these Terms and will not affect your ability to purchase products or use the Site.

28. Governing Law

These Terms and any dispute are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict-of-law principles.

However, this choice of law does not deprive a consumer of any mandatory protection provided by the laws of the consumer’s state of residence.

For disputes not subject to arbitration, you and Arcadia Labs, LLC consent to the jurisdiction of the state and federal courts located in Wyoming, except where applicable consumer law permits or requires a different forum.

29. Termination

We may suspend or terminate access to the Site or an account if we reasonably believe you have violated these Terms, engaged in fraud or abuse, threatened the Site’s security, or acted unlawfully.

Termination does not eliminate obligations or rights that arose before termination.

Provisions that by their nature should survive termination—including intellectual-property provisions, payment obligations, disclaimers, liability limitations, and dispute-resolution provisions—will survive.

30. Severability

If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

If part of the arbitration or class-action provisions is invalid, the effect of that determination will be governed by Sections 25 and 26 and applicable law.

31. No Waiver

Our failure to enforce a provision does not waive our right to enforce that provision or any other provision later.

32. Assignment

You may not transfer or assign your rights or obligations under these Terms without our written consent.

We may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, financing, or transfer of the GenetikaSkin business, subject to applicable law.

33. Force Majeure

We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, war, terrorism, epidemics, labor disputes, government actions, transportation interruptions, carrier failures, utility outages, or internet and technology disruptions.

This section does not excuse obligations that cannot legally be avoided, including any refund required under applicable law.

34. Entire Agreement

These Terms, together with the Privacy Policy, Return & Refund Policy, Shipping Policy, subscription disclosures presented at checkout, and any additional terms applicable to a specific promotion or service, constitute the agreement between you and Arcadia Labs, LLC regarding the Site and purchases made through it.

If a specific promotional or subscription term conflicts with these Terms, the more specific term will control for that promotion or subscription, unless prohibited by law.
